INTRODUCTION

Welcome to the Joint Apprenticeship Training Committee's ("JATC") website (which is referred to herein as the “Website”).

The terms "You" and "Your" refers to the user or viewer of this Website.

By using this Website, You are agreeing to comply and be bound by the following Terms of Service and Use. Please review the following terms in their entirety and ensure their comprehension before using and viewing this Website.

If You do not agree to any of the below Terms of Service and Use or the Privacy Notice (collectively, the “Terms”), You are not authorized or permitted to continue to use of this Website. Your use of the Website constitutes an acceptance of the Terms in effect at the time of Your use. By participating or just visiting this Website, including all video, audio, written, and graphic content available through this Website), You signify Your agreement to these Terms. Please read and review the Terms often since the JATC reserves the right to modify these Terms at any time as it deems necessary or appropriate at its sole discretion. Updated versions of the Terms will appear on this Website and are effective immediately.

AGREEMENT BETWEEN THE JATC AND USER

The JATC Website is comprised of various webpages operated by the JATC.

  1. The content of this Website in its entirety is subject to change without notice. Its purpose is for Your general information only. See further Terms below regarding modification of these Terms.
  2. No party guarantees the accuracy, timeliness, performance, completeness, or suitability of the content and information found on this Website. You acknowledge that errors or inaccuracies may exist, and that the JATC is in no way liable for any such errors.
  3. The JATC is not responsible and holds no liability for third-party content that may be posted on the Website by end users, or for content that is linked to from this Website including other sites. See further Terms below regarding links to third-party sites.
  4. The use of and viewing of information on this Website is at Your own risk. Any consequences of use that may occur are not the liability of the JATC.
  5. Unauthorized use of this Website or its contents may give rise to a claim for damages and/or be a criminal offense enforceable by local and international law.
  6. The JATC reserves the right to restrict access to certain areas of the Website at the JATC's own discretion. If a username and password, or any other access credentials, are provided to You as the user, it is Your responsibility to keep such information confidential.
  7. The JATC is not responsible for user-generated content, and not liable for any violations that such content may constitute.

You may not use the Website to conduct business outside of the stated purpose or to submit fraudulent information. You represent that any information that You submit on this site is true and accurate. Moreover, You represent that any information that You submit on this site is personal to You. You may not submit a third-party’s information unless You are a parent or guardian of said third-party.

NON-DISCRIMINATION POLICY 

It is the policy of the JATC that no person shall, on the basis of race, religion, color, sex, age, disability, sexual orientation, veterans status, or national origin, be excluded from, participation in, be denied the benefits of, or be subjected to discrimination or harassment (including sexual harassment) under any program or activity of the JATC. The JATC does not intend by this commitment to require compliance with this policy by governmental or external organizations that associate with, but are not controlled by, the JATC, except as required by law.

MODIFICATION OF THESE TERMS

The JATC reserves the right to change the terms, conditions, and notices under which the JATC Website is offered, including but not limited to the charges associated with the use of the JATC Website.

The JATC Website may contain links to other sites (“Linked Sites”). The Linked Sites are not under the control of the JATC and the JATC is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. The JATC is not responsible for webcasting or any other form of transmission received from any Linked Site. The JATC is providing these links to You only as a convenience, and the inclusion of any link does not imply endorsement by the JATC of the site or any association with its operators.

NO UNLAWFUL OR PROHIBITED USE

As a condition of Your use of the JATC Website, You warrant to the JATC that You will not use the JATC Website for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the JATC Website in any manner which could damage, disable, overburden, or impair the JATC Website or interfere with any other party’s use and enjoyment of the JATC Website. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the JATC Website.

USE OF COMMUNICATION SERVICES

The JATC Website may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable You to communicate with the public at large or with a group (collectively, “Communication Services”). You agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, You agree that when using a Communication Service, You will not:

  1. Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
  1. Publish, post, upload, distribute, or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful topic, name, material, or information.
  1. Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless You own or control the rights thereto or have received all necessary consents.
  1. Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer.
  1. Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages.
  1. Conduct or forward surveys, contests, pyramid schemes, or chain letters.
  1. Download any file posted by another user of a Communication Service that You know, or reasonably should know, cannot be legally distributed in such manner.
  1. Falsify or delete any author attributions, legal, or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
  1. Restrict or inhibit any other user from using and enjoying the Communication Services.
  1. Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.
  1. Harvest or otherwise collect information about others, including e-mail addresses, without their consent.
  1. Violate any applicable laws or regulations.

The JATC has no obligation to monitor the Communication Services. However, the JATC reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. The JATC reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

The JATC reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process, or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in the JATC’s sole discretion.

Always use caution when giving out any personally identifying information about Yourself or Your children in any Communication Service. The JATC does not control or endorse the content, messages, or information found in any Communication Service and, therefore, the JATC specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not authorized JATC spokespersons, and their views do not necessarily reflect those of the JATC.

Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if You download the materials.

MATERIALS PROVIDED OR POSTED TO THE JATC WEBSITE

The JATC does not claim ownership of the materials You provide to the JATC Website (including feedback and suggestions) or post, upload, input, or submit to the JATC Website or its associated services (collectively “Submissions”). However, by posting, uploading, inputting, providing, or submitting your Submission you are granting the JATC, and its affiliated companies and necessary sub-licensees, permission to use Your Submission in connection with the operation of their Internet businesses including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat Your Submission; and to publish Your name in connection with Your Submission.

No compensation will be paid with respect to the use of Your Submission, as provided herein. The JATC is under no obligation to post or use any Submission You may provide and may remove any Submission at any time in the JATC's sole discretion.

By posting, uploading, inputting, providing or submitting Your Submission, You warrant and represent that You own or otherwise control all of the rights to Your Submission as described in this section including, without limitation, all the rights necessary for You to provide, post, upload, input, or submit the Submissions.

LIABILITY DISCLAIMER

The information, software, products, and services included in or available through the JATC Website may include inaccuracies or typographical errors. Advice received via the JATC website should not be relied upon for personal, medical, legal, or financial decisions and You should consult an appropriate professional for specific advice tailored to Your situation.

To the maximum extent permitted by applicable law, all such information, software, products, and services, are provided "as is" without warranty or condition of any kind. The JATC hereby disclaims all warranties and conditions with regard to this information, software, products, and services, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title, and non-infringement.  

To the maximum extent permitted by applicable law, in no event shall the JATC be liable for any direct, indirect, punitive, incidental, special, or consequential damages, or any damages whatsoever, including without limitation damages for loss of use, data, or profits arising out of or in any way connected to the use or performance of the JATC Website.

TERMINATION/ACCESS RESTRICTION

The JATC reserves the right, in its sole discretion, to terminate Your access to the JATC Website and the related services or any portion thereof at any time, without notice.

To the maximum extent permitted by law, this agreement between the JATC and You is governed by the laws of the State of California, U.S.A. and you hereby consent to the exclusive jurisdiction and venue of courts in Sacramento County, California, U.S.A. in all disputes arising out of or relating to the use of the JATC Website. Use of the JATC Website is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between You and the JATC as a result of this agreement or use of the JATC Website. The JATC's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of the JATC’s right to comply with governmental, court, and law enforcement requests or requirements relating to Your use of the JATC's Website or information provided to or gathered by the JATC with respect to such use.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and the JATC with respect to the JATC Website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the user and the JATC with respect to the JATC's Website. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties to this agreement that this agreement and all related documents be drawn up in English.

COPYRIGHT AND TRADEMARK NOTICES

COPYRIGHT

The content in its entirety, including text content, graphics, layouts, and all source code, belong to the JATC. This term is protected by intellectual property rights and copyright law. Copying, redistribution, use, or publication either for free or for monetary gain is strictly prohibited. Some of the content on the Website is the copyrighted and licensed work of third parties.

Pursuant to Title 17, United States Code, Section 512(c)(2), notifications of claimed copyright infringement under United States copyright law should be sent to the JATC's Designated Agent.

TRADEMARKS

The names of actual companies and products mentioned herein may be the trademarks of their respective owners.

The example companies, organizations, products, people, and events depicted herein are fictitious. No association with any real company, organization, product, person, or event is intended or should be inferred.
